is this legal? why do they keep bumping up my plan without my consent

Have you made any changes to your plan recently ? Add/removed base features (like voicemail, change default data options, etc.)
Keep in mind that your price should not change, however IF you make changes to your plan (like adding features, removing features, changing base plan, etc...) you will jump to the "current" posted price of the base plan you have chosen and lose any previously grandfathered prices.
If this is not the case, then you should contat Fizz, as Dapfizzer has mentioned above.
